1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of Hearth, the website at apphearth.com, and related applications and services (the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

The Services are not intended for anyone under 18. By using the Services you represent that you are at least 18 years old and able to form a binding agreement.

3. Your account

You agree to provide accurate information, keep your credentials confidential, and are responsible for activity under your account. Notify us of any unauthorized access. We may suspend or terminate accounts that violate these Terms or applicable law.

4. Events and user-submitted content

Hearth lets users, venues, and promoters create and submit events and other content (“User Content”). You retain ownership of your User Content, and you grant Hearth a non-exclusive, worldwide, royalty-free license to host, display, and distribute it within the Services. You represent that you have the rights to submit it and that it does not infringe any third party’s rights or violate any law.

You are solely responsible for the User Content you submit. We do not guarantee the accuracy, completeness, or timeliness of event listings (dates, prices, and availability can change). We may review, moderate, edit, or remove any User Content, and may decline or delay publication, at our discretion. Do not submit content that is unlawful, infringing, misleading, or that you do not have permission to share.

5. Acceptable use

You agree not to use the Services for any unlawful purpose; to scrape, harvest, or misuse content or data; to disrupt or gain unauthorized access to the Services; or to impersonate others or misrepresent your affiliation.

6. Third-party services and ticketing

The Services surface events from third parties and may link to third-party ticketing platforms. Purchases are made through those independent providers, who are the sellers of record. Hearth does not sell tickets, process those payments, or control pricing, availability, refunds, or cancellations. Your interactions with third parties are governed by their own terms.

7. Intellectual property

The Services and their content (excluding User Content and third-party content) are owned by Hearth and protected by intellectual-property laws. Except as expressly permitted, you may not reproduce, distribute, modify, or exploit any part of the Services.

8. Disclaimers & limitation of liability

The Services are provided “as is” and “as available,” without warranties of any kind. To the maximum extent permitted by law, Hearth is not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
